This depends upon the state. Each state has a different definition of what constitutes "transacting business within the state" Some states will not regard selling products to customers physically present within the state as transacting business - it would require more of a physical presence on the part of the company (office location, warehouse location, remote employees are living and working within the state, etc). Regarding setting the price: I would try run a survey with some screen shots that show the game and it's purpose/experience, and ask potential users how much they would pay. I would run one survey with open end questions, such as: "which payment method would you prefer? Answers: one time payment, download payment, monthly payments, yearly payments.... and "How much would you be willing to pay for the service - in each of the various payment options". Then, I'd run another survey with the same questions, but provide various options for them to choose from. There is a lot of psychology behind the way the questions are done, so it is important to do them correctly. Once you've done these survey's, you'll have a better understanding of what you users are willing to pay, and how. Also, if you do the survey right, you could collect potential first clients (they would leave their email address and you can notify them when you launch). I think you can be charging much more than you are, but if you're working with smaller businesses then maybe that budget is more reasonable. Why not offer some kind of tiered option? A post is $15, highlights are $10, but if you get both they're $20—something like that. If you other avenues to distribute your news (like a newsletter, for example), you can add additional packages. I also think 3:1 is too many ads but if your audience is still engaging and there isn't a noticeable dropoff, that's not too bad.
